View the latest information on passports for nonbinary and trans New Jersey residents.
Earlier this year, U.S. Customs and Border Protection issued a bulletin removing X gender markers from the Advance Passenger Information System (APIS), which collects information about travelers entering the United States.
While passports with X gender markers are still legal and valid, as of October 12, 2025, APIS will no longer accept gender markers other than M or F from travelers. Travelers who have other gender markers, such as X gender markers, will still be allowed to enter the United States, but may be required to choose an M or F gender marker when booking plane tickets. In addition, this discriminatory new policy may cause confusion, delays, and/or harassment at the airport.
The new CBP guidance only applies to international travel. Domestic travelers who have identity documents with X gender markers should not experience problems with their documents. However, our travel and federal identity document advisory continues to be in effect and we generally advise caution for all nonbinary and trans travelers.
