On November 6, 2025, the Supreme Court of the United States granted the Trump administration’s request to enforce its discriminatory passport gender marker policy while the policy is being challenged in court.
This harmful decision is not final, and we firmly believe our colleagues at the ACLU will prevail when it comes to allowing nonbinary and trans people to live with dignity. (The ACLU’s press release about the Supreme Court’s action contains more details.)
In the meantime, if your passport was valid before today’s action by the Supreme Court, it is still valid, including if you have an X gender marker. We don’t recommend that nonbinary and trans people apply for new passports at the moment, and changes of gender marker will be rejected. If you have an application currently in process, what happens with your application will depend on how quickly this case moves through the courts and what actions are taken in the future.
